City of Malibu: Point of Sale Septic Inspection Ordinance

This controversial proposal has caused much discussion in the Real Estate community as it would require the inspection of septic systems each time a developed property is tranferred.

Called the "Point of Sale Ordinance" the proposed municipal law would require the inspection of the water waste management system at the time or within 2 years of the transfer of ownership of a property. Once the inspection has taken place a Certificate will be issued saying that transfer of title can take place.

The City says its important to note that new systems will not be needed to pass the inspection and that systems that work will be given a pass certificate and ones that dont will not be and instructions on how to remedy the problem will be issued.

On the whole it is a great idea to protect the buyer. However, the entire Real Estate Community will watch the development of this proposal and the outcome of the city council meeting on monday.
